staphylococcal infection.[81] Byrd was released on June 30, 2009.[82]
On June 27, 2010, Byrd became ill and was admitted to Inova Fairfax Hospital in Fairfax
County, Virginia, for what was assumed to be heat stroke and dehydration.[83][84]
However, other medical conditions emerged and Byrd was described as "seriously
ill."[85] Robert Byrd died at approximately 3 a.m. EDT the next day at age 92.[86]

Sen. Robert Byrd (D-W.Va.), the longest-serving Democratic senator, is criticizing President Obama's appointment of White House "czars" to oversee federal
policy, saying these executive positions amount to a power grab by the executive branch.
In a letter to Obama on Wednesday, Byrd complained about Obama’s decision to create White House offices on health reform, urban affairs policy, and energy and climate change.
Byrd said such positions "can threaten the Constitutional system of checks and balances.
At the worst, White House staff have taken direction and control of programmatic areas
that are the statutory responsibility of Senate-confirmed officials."
While it's rare for Byrd to criticize a president in his own party, Byrd is a stern
constitutional scholar who has always stood up for the legislative branch in its role in
checking the power of the White House.
Byrd no longer holds the powerful Appropriations chairmanship, so his criticism does not
carry as much weight these days. Byrd repeatedly clashed with the Bush administration
over executive power, and it appears that he's not limiting his criticism to Republican
administrations.
Byrd also wants Obama to limit claims of executive privilege while also ensuring that the
White House czars don’t have authority over Cabinet officers confirmed by the Senate.
"As presidential assistants and advisers, these White House staffers are not accountable
for their actions to the Congress, to cabinet officials, and to virtually anyone but the
president," Byrd wrote. "They rarely testify before congressional committees, and often
shield the information and decision-making process behind the assertion of executive
privilege. In too many instances, White House staff have been allowed to inhibit
openness and transparency, and reduce accountability."
The West Virginia Democrat on Wednesday asked Obama to "consider the following: that
assertions of executive privilege will be made only by the president, or with the president's
specific approval;
that senior White House personnel will be limited from exercising authority over any
person, any program, and any funding within the statutory responsibility of a
Senate-confirmed department or agency head; that the president will be responsible
for resolving any disagreement between a Senate-confirmed agency or department
head and White House staff; and that the lines of authority and responsibility in the
administration will be transparent and open to the American public."
Obama faces a decision as early as next week on whether to support a claim of executive
privilege made by former President Bush in refusing to allow Karl Rove, the former deputy
White House chief of staff, to be deposed by the House Judiciary Committee on the White
House's role in the 2006 firing of nine U.S. attorneys.
Bush claimed "absolute immunity" for top advisers in resisting such subpoenas, but
Rep. John Conyers (D-Mich.), chairman of the Judiciary Committee, filed a lawsuit
over the issue. The case is on appeal, and the Obama administration is scheduled to
file a motion next week laying out its stance on the issue.

Bill Clinton's usurping of the baffled Obama's role on point for the deal may have helped clarify the situation for many as 42 bluntly noted that Democrats have to support the Christmas Tree deal because they cannot possibly do as well in January. Powerline's John Hinderaker, for example, lays out what ought to be the thinking of every elected representative and senator: The bill has evolved from a not-very-good-deal-to-avoid-a-tax-hike plus an extension of unemployment benefits into a giant exercise in wasteful spending, and thus support for it should end. The new Congress --the one embodying the people's demand for spending restraint and continuation of existing tax rates-- can get the job done in the new year.
It may be difficult for some in the GOP leadership to admit that they got worked by the president, but better a little embarrassment now than the massive loss of credibility that goes with this bill. Besides, they didn't sign up for ethanol and windmills. Speaker-designate Boehner and GOP Senate Leader McConnell will win enormous points for walking away from a bad deal that has gotten worse by the hour. If the leadership does not shift course, individual GOP representatives will have to make the tough choice to part with leadership and demonstrate a true commitment to fiscal reform. Hopefully such an unnecessary and divisive showdown will be avoided, and the GOP regain the momentum they had achieved on November 2. TeaPartyPatriots.org has begun to mobilize its grassroots network to oppose the deal, and other Tea Party organizations are surely making the same appeal. MSM is of course three days behind in their rpeorting, but with no House vote occuring any sooner than Wednesday, the story of Stimulus II is just beginning to be written. |

It's time for Congress to reflect the seriousness of the people they are supposed to be

Though Not as Crazy as Doing Nothing As the controversial deal for extending the tax cuts to middle class and wealthy Americans drew closer to become reality, some feared that the true loser would be the clean energy
sector, which relies on tax breaks that must be annually renewed by Congress. Those tax
breaks were initially absent from the deal, leading to speculation that their absence would
cause the industry to shed jobs and lose its already fragile footing. The breaks are back in
now, but this whole debacle gives us an opportunity to examine the dubious nature of this
short-sighted approach to stimulating clean energy growth -- in other words,
this is why the policy of extending tax breaks every year is crazy.
