The Model State Emergency Health Powers Act
The Model State Emergency Health Powers Act (MSEHPA) grants public health powers to state and local public health authorities to ensure a strong, effective, and timely planning, prevention, and response mechanisms to public health emergencies (including bioterrorism) while also respecting individual rights. Developed through the Center with additional funding support from the Alfred P. Sloan Foundation, MSEHPA has been used by state and local legislators and health officials nationwide as a guide for considering public health law reform in their states. An initial draft of the Act (as of October 30, 2001) was superceded by the Act's final version (as of December 21, 2001). Legislative Status Update: Since its completion on December 21, 2001, the Center has been tracking state legislative activity related to MSEHPA. As of April 15, 2006, the Act has been introduced in whole or part through bills or resolutions in forty-four (44) states, the District of Columbia, and the Northern Mariannas Islands. Thirty-seven (37) states [AL, AK, AZ, CA, CT, DE, FL, GA, HI, ID, IL, IN, IA, LA, ME, MD, MN, MO, MT, NV, NH, NM, NC, OK, OR, PA, RI, SC, SD, TN, TX, UT, VT, VA, WI, and WY] and DC have passed bills or resolutions that include provisions from or closely related to the Act. The extent to which the Act's provisions are incorporated into each state's laws varies. Click on the activity table link and you can follow just exactly your own state is handling this bill up to current time. Not each state is voting in all points of it for their individual states. Now, didn't I read somewhere else on this site, that the CDC is advocating info that is NOT conflicting in an emergency situation? So, it seems to me that by EACH STATE passing different variations of this State Emergency Health Powers bill, conflicting info is going to be given out regarding how emergency meds are dispensed, quarantine issues, how civilians are conscripted, distribution of supplies! So would that create another set of troubles for bordering states .... say like PA & NJ , Utah & Nevada, Fla & Carolina -- one state has regs the other doesn't so people are crossing over to take advantage of what they can't get in their state (kinda like teens taking advantage of an earlier drinking age in a neighboring state!). No wonder it's 4 years later and this is still in the works!-k
